Move to order at 6:30PM a combined meeting during the BOS meeting with the Friends of the Bandstand (FOB) and Cemetery & Parks Department. Present from the Cemetery & Parks, Tubby Boucher, Brian Sanford, John Barrett, Roger Rapoza and Pam Haman

 

A discussion was had on who actual controls/oversees the town common and bandstand.  The Cemetery and Parks currently maintains both the common and bandstand. John, for the Cemetery & Parks Commission expressed the opinion that the “ownership” is in the Town of Townsend but that pursuant to Chapter 45 the Cemetery & Parks Commission has oversight over the common and bandstand.  Harrison has researched the issue of who oversees the common finding that if the deed does specifically state “dedicated for park purposes”, the common would come under the jurisdiction of the park department.  A copy of the deed was found stating that common was transferred to the Town of Townsend so the BOS feels they have jurisdiction.

Further discussion followed about who actually oversees the common and bandstand.  The Cemetery & Parks maintains both the common and bandstand.  The BOS has become involved because of disagreements between the FOB and Cemetery & Parks regarding the restoration of the Bandstand.  The grant of $50,000 was awarded to the Town of Townsend.

Veronica, BOS member wants to see a nice bandstand for the town.  Does the current bandstand fit the needs of today?

Chaz, BOS member supports restoring the bandstand, needs to be safe and meet the needs of the community.

 

The Building Inspector reminded all that if you do more than 30% of the value you will need to comply with ADA/architectural access.  Might be able to seek a variance for a historic structure. Eric also stated that compliance doesn’t mean lead free.

 

It was noted that the Historic District Commission back in the fall (October, 2021) had approved restoration changes submitted by the FOB.

The group reviewed/discussed the restoration plans and most recent architect report from Lorgin who stated that the bandstand is structurally sound.

 

Alicia Struthers from FOB felt what is historical is its appearance.  The style is what is important not type of wood so if wood is rotten replace.

Bill Martin from FOB, feels that from roof down should be replaced.

Betty Mae Tenny from Band Concerts was concerned about the back porch addition.  It needs to stay for band space needs.  She does not want an open ceiling because of the way music carries.

 

The BOS voted to return the issue to the FOB and Cemetery and Parks. With the intent that the two groups will meet to figure a way forward together or BOS will make the decision.  Cemetery & Parks with the FOB will attend 6/7/22 BOS meeting.

 

The joint meeting adjourned at 8:00PM.
